
Hopper Inc. and its affiliates ("HTS"), provides the Cancel For Any Reason™ service ("CFAR") to customers in connection with certain otherwise non-refundable bookings of WestJet flights purchased by users ("you") through the websites and mobile web page (the "Site") of WestJet ("WestJet").
CFAR is provided subject to and in accordance with the terms and conditions set forth below (the "CFAR Terms"), HTS’ general Terms of Service applicable to all HTS services, sites, and apps, and HTS’s Privacy Policy. By purchasing CFAR, you agree to the CFAR Terms, HTS’s general Terms of Service and Privacy Policy.
Your booking of WestJet flight(s) and use of the Site are subject to WestJet’s Terms and Conditions, Tariffs, and Privacy Policy.
1. How it works. CFAR is available for purchase through the Site, must be purchased with a credit card and is payable to HTS. If you have purchased CFAR through the Site in relation to a booking, you may cancel that purchased booking through clicking the link sent to you with the confirmation email or in the "Manage Trips" section at www.westjet.com and receive a full or partial refund, as provided in the below paragraphs. Neither documentation nor reason will be required in order to cancel. After the timeframe specified in Section 3 of these CFAR Terms has passed, CFAR will expire and any changes or cancellations to your booking will be subject to the fare rules imposed by WestJet.
2. Non-Refundable CFAR Fee. The fee to purchase CFAR (the "CFAR Fee") is a non-refundable service fee, with the limited exception stated in Section 6 below.
3. Valid Cancellation. Except as provided in Sections 6 and 7, in order to be eligible for a refund from HTS, you must cancel your booking using the link provided in the confirmation email sent by WestJet or in the "Manage Trips" section at www.westjet.com within the timeframe specified to you at the time of purchase and stated in your confirmation email.
4. Form and Amount of Refund. Upon a valid cancellation of your booking, HTS will refund to you the percentage of the cost of your purchased WestJet flight ticket including the base fare and applicable taxes, fees and charges, as specified to you at the time of purchase and stated in your confirmation email, as well as any additional services expressly identified as covered under the CFAR option that you purchased (collectively, the "Included Amounts"). Included Amount is based on your original ticket and does not cover any subsequent tickets or other services added after the original ticket purchase due to changes you made to your booking. CFAR does not entitle you to a full refund of all trip costs (including, for example, the CFAR Fee or other purchased add-ons such as trip insurance). A valid exercise of CFAR entitles you only to the percentage of the Included Amounts described above. For clarity, any amount not part of the Included Amount is forfeited, no refund or credit will be issued. To the extent that you receive a refund from HTS for any Included Amounts in connection with a cancellation, such refund will satisfy any right you may otherwise have to receive a refund of those same amounts from WestJet in respect of that cancellation. Accordingly, you agree not to seek, and you waive any right to obtain, a duplicate refund from WestJet for any Included Amounts refunded to you by HTS. For clarity, this waiver applies only to amounts that are included in CFAR and refunded by HTS. Any amounts that are not included expressly under CFAR, or that are refundable directly by WestJet in accordance with its fare rules and policies (including, for example, prepaid baggage where applicable), remain subject to WestJet’s standard refund processes.
5. Getting Refunded. HTS will process your refund to your original form of payment that you used to purchase CFAR. If HTS is unsuccessful in processing a refund to your original form of payment, then HTS will utilize Wise as an alternative payment service (a "Third Party Payment Service") to facilitate the refund. These services are subject to the Wise Terms of Service and Wise Privacy Notice. Please note that these services are not supported if you are accessing them from a country that is not supported by Wise.
The Third Party Payment Service is provided by third-parties not affiliated with WestJet or HTS. Third Party Payment Service may collect certain information from you and conduct compliance checks in accordance with applicable laws and regulations. Your completion of these compliance checks and receipt of the refund will be subject to direct agreements between you and the applicable Third Party Payment Service, without further involvement from WestJet or HTS in the terms of such agreements. If you do not satisfy any of the compliance requirements, you will be required to directly contact WestJet (who is not ultimately responsible or liable for the refund process and/or its outcome), and you may ultimately not be entitled to any refund. WestJet and HTS shall not be liable if the Third Party Payment Service is unable to process payments due to any incorrect or incomplete information provided by you, sanctions, compliance restrictions, or geographic limitations. Refunded amounts will be processed within ten (10) business days of the request. By submitting your refund request, you acknowledge and agree to the terms and conditions of the applicable Third Party Payment Service.
6. Exclusions. CFAR is not available to exercise following the earlier of:
a. any voluntary cancellation by you during the WestJet permitted void window;
b. a cancellation of any flight by WestJet for any reason, including as a result of a force majeure event; or
c. any circumstance in which a change by WestJet to your flight, booking, or itinerary for which a CFAR Fee was paid, entitled you to compensation from WestJet under the Terms and Conditions or under applicable law.
In the circumstances described in 6(a) through (c), whether you are entitled to a refund from WestJet for all or any portion of the amount you paid for your booking will be determined by the applicable fare rules. Except for a cancellation under Section 6(a) above, in all cases the CFAR Fee will remain non-refundable.
7. Other Restrictions.
a. CFAR may only be purchased at the time of booking and may not be added after the booking.
b. CFAR must be purchased for all passengers on the booking, and for all segments or legs of such booking. Exercising CFAR for any flight in the booking will result in a cancellation of all purchased flights for all legs or segments (i.e., outbound and return flights). If there is more than one passenger on the booking, the primary passenger on the booking controls the exercise of CFAR, which shall apply to all passengers included on the travel itinerary.
c. You cannot use CFAR on bookings originally made for two or more passengers that are subsequently split into separate reservations.
d. If your purchased flight has been modified at your request after booking (including changes to the origin, destination or date of travel), you can still use CFAR. However, your right to use CFAR will expire at the earlier of (1) the original cancellation deadline as described in Section 3 or (2) 24 hours prior to your newly scheduled departure for the first flight on your itinerary. If you cancel your booking after this time, you will not be entitled to any refund from HTS. CFAR will apply only to the original amount of the originally purchased flight, without taking into account any changes to the total purchase cost resulting from your decision to modify the booking.
e. HTS may not offer CFAR on every flight offered on the Site. HTS reserves the right to deny the purchase of CFAR to any customer for any lawful reason. If you modify your itinerary in a way that results in CFAR being applied to a flight not eligible for CFAR, HTS reserves the right to terminate the CFAR service immediately.
f. Except as otherwise explicitly provided in these CFAR Terms, CFAR is only valid for the booking for which CFAR was purchased, is not transferable and cannot be carried over to any future bookings.
8. Application of Certain Taxes. If the CFAR Fee is subject to applicable taxes, they will be set forth and charged on the Sites at the time of purchase.
9. Additional Information. Certain jurisdictions, including Canada and the European Union, have adopted laws and/or regulations requiring airlines to compensate passengers in the event of certain cancellations, delays or other disruptions to scheduled air travel (a "Passenger Rights Regime"). You may have rights under these Passenger Rights Regimes regardless of whether you purchase CFAR. The value CFAR provides is as a quick and easy way for you to get a refund in the event you decide to cancel your flight, without having to go through your airline carrier. 10. Not Insurance. Subject to the restrictions and exclusions described in these CFAR Terms, CFAR is not insurance and is not regulated as such.
11. Amendments. HTS may make changes or updates to these CFAR Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued purchase of CFAR after posting of any changes constitutes your acceptance of the amended CFAR Terms.
