Hopper (USA), Inc. and its affiliates (“Hopper”) provide the Hopper Cancel For Any Reason™ for Flights services (the “Services”) through the travel search, booking sites and/or apps accessible via web and/or mobile device (the “Sites”) provided and owned by Travix Nederland B.V., (“Travix”) .
The Services are provided subject to and in accordance with the terms and conditions set forth below (the “CFAR Service Terms”). By using the Services, you agree to the CFAR Service Terms, Hopper’s Terms of Service, and Hopper’s Privacy Policy.
1. How it works. If you have purchased the Service for a flight on the Sites, you may cancel that purchased flight through the Sites and receive a full or partial flight refund, as provided in the below paragraphs. Neither documentation nor reason will be required in order to cancel. Except as provided in Section 5, to be entitled to a refund under the Service you must cancel your flight purchase after the void window and at least twenty-four (24) hours prior to your first scheduled departure or before such other time as indicated to you prior to purchase and as reflected in your confirmation email. After your specified timeframe has passed, the purchased Service will expire and any changes or cancellations to your purchased flight will be subject to the fare rules imposed by the airline or carrier for your ticket.
2. Void Window. You may have the legal right to cancel your flight within a specified number of hours after purchase (the “void window”) and receive a full or partial refund from the airline, even if you do not purchase the Service. If you cancel your flight within the void window, you will be entitled only to the amount and form of refund provided to you by the airline. You will not receive a refund for the cost of the Service.
3. Nonrefundable. The fee to purchase the Service is nonrefundable.
4.Entitlement to Flight Refund; Flight Refund Amount. Upon valid exercise of your option to cancel for any reason, and subject to the completion of the process described in Section 5, you will be entitled to a refund equal to all or a portion of the total cost of your purchased air travel (base fare and applicable taxes and fees) and, if applicable, specified ancillaries (baggage fees and the cost of seat upgrades). The refund entitlement amount is specified upon your purchase of the cancellation option and in your confirmation email.The Service does not entitle you to a full refund of all flight costs. No additional expenses other than the cost of the air travel purchased through the Sites will be reimbursed (including, for example, the Service fee or any other purchased items such as flight insurance or hotel bookings).
5. Flight Refund Process. Hopper utilizes Hyperwallet payment services to deliver payments to you. Such payment services are subject to the Hyperwallet Terms of Service and the Hyperwallet Privacy Policy. Payments by Hopper of reimbursed amounts will be processed within ten (10) business days. Hyperwallet is a service provided by a third-party not affiliated with Hopper. To use Hyperwallet to receive your refund, you will need to enter into a direct contract with Hyperwallet and agree to comply with the applicable terms and conditions linked to above. Payout options made available to you will be chosen in the sole discretion of Hyperwallet and, depending on the options made available for you, you may be required to create an account with Hyperwallet, if you do not already have one, in order to receive your refund. Before paying you your refund, Hyperwallet may be required to collect certain information from you in order to comply with anti-money laundering, sanctions and other requirements. If you do not satisfy any of these requirements (as determined by Hyperwallet and without input from Hopper or Travix), you will not be entitled to any refund. Because you will enter into a contract directly with Hyperwallet any liability or obligations Hyperwallet owes to you in relation to your use of Hyperwallet will be determined by your agreement with Hyperwallet, and not by Hopper or Travix.
6. Modifications. If your purchased flight has been modified at your request after booking, the Service will apply only to the original amount of the purchased flight and will expire 24 hours prior to the first scheduled departure of your original purchased flight.
7. Exclusions. Other than as provided in Section 2, the Service does not apply following the earlier of:
a. a cancellation of any flight by an airline carrier for any reason, including the result of a force majeure event;
b. a declaration of an “emergency” or similar “extraordinary measures” taken by any governmental authority in the destination city, region, or country of your flight, or issuance of a Safety and Security Alert by the United States Department of State or a Travel Health Notice Warning by the United States Center for Disease Control (CDC) for such destination; or
c. a designation by the World Health Organization (WHO) that the destination city, country, or region of your flight is at risk from COVID-19.
In the event of such cancellation, or change, declaration of emergency, alert, notice, designation, or other similar government action, your purchased Service shall expire immediately and a refund of your flight purchase will be subject to the fare rules imposed by the airline carrier for your ticket.
8. Other Restrictions. The Service may only be purchased at the time of booking, and may not be added after the booking. The Service must be purchased for all passengers on the booking, and for all segments or legs of such booking. Exercising your Service for any flight in the booking will result in a cancellation of all purchased flights for all legs or segments (i.e., outbound and return flights). If there is more than one passenger on the booking, the passenger who made the booking shall determine how to exercise the Service, which shall apply to any other passenger included on the travel itinerary. The Service may not be offered on every flight made available through the Sites. Hopper reserves the right to deny the purchase of the Service to any customer for any lawful reason. The Service is only valid for the booking for which the Service was purchased. The Service is not transferable and cannot be carried over to any future bookings.
9. Additional Information. Even if you do not purchase the Service, under certain circumstances you may be eligible for a refund from your airline carrier in the event of certain circumstances. For example, if you are traveling into or out of the European Union, or on an EU-based airline, you may have rights in the event that the airline carrier for your flight cancels, delays or denies you boarding. The value the Service provides is as a quick and easy way for you to get a refund in the event you decide to cancel your flight, without having to go through your airline carrier. 10. Not Insurance. The Service ensures that airline tickets purchased on the Sites can be canceled for any reason without incurring additional fees. Hopper and Travix provide the Service to provide a more seamless and flexible experience for travel booked on the Sites. The Service Terms are not intended to constitute an offer to insure, do not constitute insurance or an insurance contract, and do not take the place of insurance obtained or obtainable by you.
11. Changes to the CFAR Service Terms: Hopper reserves the right to amend these CFAR Service Terms. During the purchase process, the most recent version of these CFAR Service Terms will always be made available to you.
